An extension to file is not an extension to pay tax.
North Dakota recognizes extensions granted for federal returns: as a matter of the Tax Commissioner's published administrative practice, the state filing deadline moves to the same date as a granted federal extension without a separate state application. A taxpayer who needs more time than the federal extension provides, or who has no federal extension, applies using Form 101 and must show good cause; an extension beyond the federal period is discretionary, not automatic. Both the automatic conformity and the discretionary Form 101 extension are exercises of the same statutory authority - the Tax Commissioner's general power to grant a filing extension for good cause - so the underlying statute does not itself use the word "automatic"; that description comes from the Tax Commissioner's own published guidance applying that authority.
| Item | Detail |
|---|---|
| Form required | None if relying on the federal extension; Form 101 for additional time or if no federal extension exists |
| Automatic | Yes, per Tax Commissioner guidance, for the same period as a granted federal extension - this is administrative practice, not language appearing in the statute itself |
| Extension length | Matches the federal extension; further time requires good cause under the Tax Commissioner's discretionary authority |
| Authority | N.D. Cent. Code §57-38-34(6) (Tax Commissioner's general authority to grant a reasonable extension for good cause); ND Office of State Tax Commissioner guidance (tax.nd.gov/filing-extension) for the automatic-conformity practice specifically |
